RightCount Applauds Georgia Supreme Court Ruling Striking Down Unconstitutional State Election Board Rules
Atlanta, Ga. – RightCount Georgia helped to secure a major legal victory for both the separation of powers and the integrity and security of Georgia’s elections. Today, the Georgia Supreme Court held that the State Election Board overstepped its authority when it attempted to pass rules requiring a hand count of ballots at polling places and other procedures not authorized by Georgia law. RightCount, led by Georgia Chair former State Senator Eric Johnson, submitted an amicus brief from Republican former legislators that argued that the state legislature was the proper body to determine Georgia’s election policy and that the State Election Board could not constitutionally usurp power reserved to the legislature. The Georgia Supreme Court largely agreed with RightCount’s position in its amicus brief, determining that the four rules exceeded the State Election Board’s statutory rule-making authority. RightCount Georgia Chair Eric Johnson, said:

It’s a commonsense, conservative position that the legislature, not unelected bureaucrats like the State Election Board, makes the law. I was proud to stand with my Republican former colleagues in the General Assembly to push back against unelected bureaucrats, no matter which party they are from, when they try to usurp powers that are constitutionally reserved to the legislature. And I was pleased that the Georgia Supreme Court agreed with our position. Today’s decision protects the constitutional balance of power and ensures that the votes cast by Georgia citizens are counted and certified in accordance with the law, free from manipulation and partisan influence.”
